Terms of Service

1. Acceptance of Terms
By creating an account or using WaivedIn (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users of the platform, including individuals signing waivers and businesses using the dashboard.
2. Description of Service
WaivedIn provides a digital waiver signing and check-in platform. Individuals can create an account, complete a profile, and sign liability waivers on behalf of themselves or their dependents. Businesses can use the WaivedIn dashboard to manage waivers and verify participant check-ins.
3. Accounts and Eligibility
You must be at least 18 years of age to create an account. By creating an account, you confirm that you are 18 or older. Parents and guardians may add minors as dependents under their account and sign waivers on their behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Digital Signatures and Legal Validity
By signing a waiver through WaivedIn, you acknowledge that your digital signature carries the same legal weight as a handwritten signature under applicable electronic signature laws, including the Electronic Commerce Act (Canada) and equivalent provincial legislation.
You agree that the signed waiver PDF generated by the Service accurately represents your agreement to the waiver content as presented at the time of signing.
5. Accuracy of Information
You agree to provide accurate, complete, and up-to-date information when creating your profile and signing waivers. Providing false information — including false names, dates of birth, or signing a waiver on behalf of someone without authorization — may result in account suspension and potential legal liability.
6. Signing on Behalf of Dependents
When you sign a waiver for a dependent, you confirm that you are the legal parent or guardian of that individual and are authorized to sign legal documents on their behalf. You accept full responsibility for the accuracy of information provided for dependents under your account.
7. Business Users
Businesses using the WaivedIn dashboard are responsible for the content of their waiver templates. WaivedIn is a platform provider — we do not review, validate, or take legal responsibility for the content of individual business waivers.
Businesses must not use participant data obtained through WaivedIn for any purpose other than managing participation at their facility.
8. Prohibited Uses
You agree not to:
- Use the Service to sign waivers fraudulently or under a false identity
- Attempt to access accounts or data belonging to other users
- Use automated tools to interact with the Service without permission
- Reverse engineer, copy, or redistribute any part of the platform
- Use the Service in violation of any applicable law
9. Limitation of Liability
WaivedIn is a tool for facilitating digital signatures and record-keeping. We do not provide legal advice and do not guarantee that any waiver signed through our platform will be enforceable in any particular jurisdiction. The enforceability of a waiver depends on its content and applicable local law — not the platform used to sign it.
To the maximum extent permitted by law, WaivedIn Inc. shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
10. Termination
We reserve the right to suspend or terminate accounts that violate these Terms. You may close your account at any time by contacting support@waivedin.ca. Termination does not delete signed waiver records, which may be retained for legal compliance purposes.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
